Subject description

This subject examines the notion of the state and state power; limitations on state power; the notion of division and separation of powers; mechanisms of accountability and control of government officials, including access to government information, the Ombudsman, merits review tribunals and judicial review.

Learning outcomes

On successful completion of this subject, students will be able to:

Identify the key principles of administrative law, including accountability, responsible government and the rule of law;
2.
Exercise knowledge and skills in researching reasons behind administrative decisions;
3.
Describe Commonwealth procedures for obtaining access to information about government and seeking review of administrative decisions by Ombudsmen, by tribunals and courts;
4.
Differentiate between merits appeals and judicial review; and
5.
Apply their knowledge to a range of scenarios relating to government actions.
